Inside a blistering order yesterday, a county judge in Alabama called enough on a single city's utilization of a private probation company that passes on fees for its work to people convicted of crimes and then throws them into jail when they can't pay. A legal court notes these generally fell into disfavor by the early 1800's, although the practice seems to have remained the norm in Harpersville. From a fair reading from the defendants' testimony one might ascertain that the more apt description from the Harpersville Municipal Court practices is that of a judicially sanctioned extortion racket. Most distressing is the fact that these abuses happen to be perpetrated in what is supposed to be considered a court of law. Disgraceful.
Judge Harrington writes the list of ways constitutional safeguards happen to be violated is simply too long to chronicle, but he spells several. Number eight caught my eye: "Defendants interminably locked in the county work release program until all fines and fees are paid entirely." The list goes on as well as on. A friend's son received drunk driving (he admits he was wrong) but once he got swept up in the system it had been frightening. He was just here for a trip but had to stay 6 months to deal with this. Luckily he had a few thousand he had in the bank but even which was not enough. He spent every minute of each and every day coping with this. He lost his licence and could not drive but was lucky enough to get find a job he could walk to, then each night he'd to find an AA meeting that was willing to sign his court slip. That's the whole idea; you aren't supposed to escape from under it. Chain gangs were notorious as sources of cheap labor and cash for police force officers who ran them. They got a kick-back from the those who own the facilities for each kid sentenced. Wonder if they skim off the the surface of the work release money?

I don't think Brian put his foot in his mouth. This can be a republican state the screams smaller government. After all, look how easy it is for them to stuff their pockets when it is private businesses they hire. Nobody said all republicans can be harmful.
And again, I'll say Remember Haliburton and just how they scammed our government and our own Service women and men? Supplying tainted water and only supplying 1 meal for each three they charged for!
My husband is a Vet Nam Vet who served about the USS America. There is a crew of 5000 which ship ran with no independent contractors, The Crew ran that ship. That's the way it should still work!
If you are in the service,[link widoczny dla zalogowanych], you've got a job, if you do that job there is no need of these greedy bastards to ever get contracts. In my opinion, if this changed, this is where everything started getting so beyond control!
In 2000, I visited prison in CA for something Used to do. I am not claiming I had been innocent. I had been given a sentence and had to pay for restitution. In those days, the state had a small jail for those who were given restitution amounts. If you were lucky, you went there, found employment from our community, and also worked rather than staying in the large prisons. In exchange, whenever you got paid, they'd take the check, cash it, and you'd get 1/3 you could use. 1/3 went to pay your restitution, 1/3 was kept as your 'rent', and the rest was to work with. Now here's the kicker. You can only go there if you had 3 years or less left in your sentence. So if you went there at the three year point and located employment fast, you had a chance to pay off a pleasant chunk of your debt. But some of the former inmates found out, after they left and reported directly into their community parole officer, that they'd gotten NO credit for the money they'd paid that was said to be going for their restitution. Zero. One filed case but I've never heard exactly what the results were. It got closed in 2002 because CA was 'too broke to maintain it open anymore."
This only corrects the lesser of the crimes committed in law enforcement in this particular case. Scott-m indicates a scam that states have been perpetrating for several years, making this kind of system much more egregious. You pay a booking fee that happens to be a filing fee to have an Appearance Bond. Then, if you do not appear in the court the court collects on the bond and you are the surety for the bond, hence the issuance of the Failure to Appear Order. The Bench Warrant is you hear about because it is the only lawful strategy a genuine court can take,[link widoczny dla zalogowanych], but courts have been making millions for many years with this type of municipal scam. Have someone request a copy from the Appearance Bond free of charge and see how harshly a court will treat you if you press. That's a well kept secret.
